Millions of individuals who previously bought an Apple or Samsung smartphone may be eligible for compensation in a significant legal action initiated by Which? against a major tech corporation.

The lawsuit revolves around whether Qualcomm possessed market dominance and, if so, whether it misused its position. Qualcomm is a leading global technology firm specializing in wireless telecommunications products, software, and services.

Which? alleges that Qualcomm imposed inflated fees for technology licenses on manufacturers like Apple and Samsung, which it believes were eventually passed on to consumers through higher prices.

The trial commences today and is set to last for five weeks at the Competition Appeal Tribunal in London. If successful in this initial phase, a second trial is expected, with Which? seeking damages estimated at around £480 million.

Which? has identified potential impacts on consumers who bought an Apple or Samsung smartphone between October 1, 2015, and January 9, 2024. If successful, an estimated 29 million individuals could receive approximately £17 in compensation per phone. The claim would automatically cover consumers who purchased specific models of Apple or Samsung smartphones.

It is important to note that there is no guarantee of compensation at this stage; the case must first succeed in the Competition Appeal Tribunal.

Anabel Hoult, the CEO of Which?, stated, “This trial marks a significant moment, showcasing how consumer power, supported by Which?, can hold major companies accountable for any misuse of their dominant market position. Without Which? leading this claim on behalf of millions of affected UK consumers, seeking damages from the company on an individual basis would not be feasible. This underscores the importance of consumers uniting to demand the redress they deserve.”

The Mirror has reached out to Qualcomm for a comment.

If you are not bound by a contract, you might be overpaying for your mobile phone. Consider comparing prices using a comparison website to potentially find a more cost-effective deal. When comparing prices, assess your current usage of minutes and data to determine the suitable package for your needs.

SIM-only deals typically offer the most affordable phone tariffs since they cover only minutes, data, texts, and other allowances, excluding the handset cost.

If you prefer not to switch providers, engage with your current provider, discuss the competitive prices you have found, and attempt to negotiate for better rates. Keep in mind that if you are under contract, switching may incur an exit fee.
